These Terms applies to all Users of the Website.

This website is for the purpose of providing digital content. Users are not permitted to edit, cut, copy, download, reproduce, distribute, modify, display or make use of the contents of this website, except stream content in temporary storage on one computer/mobile solely for their personal and non-commercial use. Any unauthorized use of the content and services of the website may violate copyright laws, trademark laws as well as the laws of privacy and Hungama is not responsible for the same. 'Unauthorized use' shall mean and include any usage of the digital content of this website in contravention to the rights granted under this term. Except as expressly provided above, nothing contained herein shall be construed as conferring any license or right under any copyright or other intellectual property right.

Hungama reserves the right, at its discretion, to change, modify, add, alter, delete or remove portions of these terms. This Agreement shall continue to be in full force and effect for so long as you are using the services of the website. Your continued use of this website following the posting of any change or modification of these terms will mean you accept those changes or modifications. Hungama reserves the right to withdraw access to this website and to change, modify, revise the materials, products and pricing listed or offered through this website at any time without notice. It is your responsibility to check these terms and conditions periodically for changes.

To avail the services being provided on the website, you will be required to submit the information/data as required at the time of registering with the website. You agree to provide Hungama with accurate, complete and updated information while doing registration. If you do not provide Hungama with accurate, complete and updated registration information, you are not authorized to use the services of the website and Hungama has the right to indefinitely suspend or terminate your account/subscription and refuse to provide you with access to.

You further agree that, in providing such registration information, you will not knowingly or otherwise omit or misrepresent any material facts or information and that you will promptly enter correct and/or updated registration data/information, or otherwise advise us promptly in writing of any such changes or updates. You further consent and authorize Hungama to verify your registration data as may be required for your use of and access to the services of the website, as applicable.

You agree and understand that the services on the website are advertising supported and you grant Hungama the right to disclose the registration data to third parties for marketing of its services. Further you agree and grant Hungama the right to use your individual registration data to provide targeting of advertisements and other service offers. The use of this website is also subject to Hungama's Privacy Policy.

USER ACCOUNT & SECURITY All registered users shall have a user name and password. It shall be the sole responsibility of the users to maintain the confidentiality and security of their account. You should not reveal your account information to anyone else or use anyone else's account. Your 'user account' and password are personal and should be kept confidential. You agree that you will not allow another person to use your 'user account' to access and use the service under any circumstances.

You are solely and entirely responsible for maintaining the confidentiality of your 'user account' and for any charges, damages, liabilities or losses incurred or suffered as a result of your failure to do so. Hungama is not liable for any harm caused by or related to the theft of your account information, your disclosure of your 'user account', or your authorization to allow another person to access and use the services using your 'user account'. Furthermore, you are solely and entirely responsible for any and all activities that occur under your account including any charges incurred relating to the services and you agree to immediately notify us of any unauthorised use of your account or any other breach of security.

Although Hungama will not be liable for any losses you may incur due to any unauthorized use of your 'user account', you may be liable for the losses of Hungama and/or other users due to such unauthorized use. In consideration of your use of the website and services provided therein, you agree, where information is requested, to provide true, accurate, current, and complete information about yourself, and to maintain and update it promptly. You agree that if any information you provide is false, inaccurate, not current, or incomplete, we may terminate your use of the website and/or the services provided there under.

If you violate, breach or fail to comply with any clause of this Agreement, we may terminate this Agreement or restrict or suspend or terminate your use of the services of immediately and without notice. You may terminate the services by ceasing to use the website. Your determination of the services shall lead to cessation of your access to the services you have subscribed for. However, you cannot escape your liabilities and obligations to pay accrued charges, if any, till date of termination of service reflecting as unpaid in your account.

We reserve the right to terminate your use of the services/subscription, without cause, upon reasonable notice. In case such termination occurs in the middle of your subscription period and you have not exhausted the downloads permitted to you under the applicable payment plan, we shall refund to you the unutilized share of your prepaid subscription fee for the remaining unused downloads which shall be calculated on a pro-rata basis in case of unlimited usage accounts.

The failure of Hungama to take any action in respect of a breach of these terms and conditions shall not constitute a waiver of their enforceability. Hungama reserves its rights in respect of these terms and conditions at all times.

Participation in this Khazana Artist Aloud Talent Hunt ("Contest") is voluntary and by participating in this Contest, the contestants agree to be bound by these terms and conditions.

The Contest is open to any contestant across the globe who wishes to participate.

On submission of the video the user will be sent an OTP for him/her to be able to authenticate the mobile number so that the entry is genuine and the contestants are accessible if he/she needs to be reached out to. Once user enters the OTP on the dashboard and clicks on "OK" their entry will be submitted which will then be moderated by Hungama Artist Aloud who will have full rights to approve or disapprove the content of the video. Approved content will be reflected on the website under Entries tab.

On the Contest dashboard, participants can upload only one video per participant (physical file). The content should be a video only (Not just audio).

The song performed should be either an original or a traditional Ghazal only. No filmy Ghazals.

The content of the video uploaded by the contestants on the Contest dashboard will be the property of Hungama Digital Media Entertainment Private Limited who will be entitled to use the same for promotional purpose only.

The contestant’s images, video recordings and or any reproductions/adaptations resulting from this Contest may be used by Hungama Artist Aloud for online publicity, promotional purposes and or for any other purposes at the discretion of Hungama Artist Aloud.

All participants’ videos will be scrutinised as per the conditions below and will be deleted immediately without any prior notice to the participants and Hungama Artist Aloud will not be held liable for such action, in the event of the following:

• Participant's video is not a Ghazal video.

• Participant video does not have a performance with harmonium / guitar and tabla.

• Participant's video does not involve participant's performance in the video.

• Any explicit content including but not limited to defamatory content, violent content, adult content, offensive content, content hurting religious sentiments etc.

Hungama Artist Aloud will not be responsible in any manner to anybody including any of the participants for the misuse of any video submissions at this Contest.

The Jury will shortlist Top 20 contestants out of all the entries that come in online.

Following participants' videos have been shortlisted for the Jury Round. The said participants have been shortlisted solely on the basis of the entry requirements listed here on and on the basis of their performance. The Jury's decision of the aforesaid shortlisted participants is final and cannot be contested

The Top 20 selected contestants will have to come to Mumbai to each give a Live Performance in front of the Jury Members who will select two winners from them.

The performances need to be accompanied with a Tabla and a Harmonium / Guitar.

All travel expenses to and fro Mumbai along with stay, food & beverage, etc. will need to be borne by the contestants themselves. Khazana Team won’t be responsible for any Boarding & Lodging for the Top 20 Contestants.

The final 2 winners will get a chance to perform at the Khazana Ghazal Festival 2019, one on each day of the festival.

Hungama Artist Aloud reserves the right to cancel or amend the Contest and these terms and conditions without notice and changes to the Contest will be notified to the contestants as soon as possible.

The Travel, Stay, Food & Beverages will be taken care of by the Organizers for the Final 2 Winners Only if they are from India. For any winner selected and is outside of India, the travel cost will have to be borne by the Winner. However, ONLY stay, food and beverages will be taken care of by the Organizers.

The Cost for anyone accompanying the Winner will not be borne by the Organizers.

Contestants acknowledge that they will not receive any compensation, benefits etc. by participating, getting shortlisted and or by winning this Contest, except as mentioned herein and hereby release Hungama Artist Aloud and its agents and assigns from any and all claims which may arise out of or are in any way connected with this Contest.

The Contest and these terms and conditions will be governed by Indian laws and any disputes arising from the same will be subject to the exclusive jurisdiction of the courts of Mumbai.
